Ashley St Clair’s lawsuit against Elon Musk has shared alleged text messages between the two following her claims that she’d given birth to his 13th child.
Yesterday (February 22), it was revealed that the author had filed two petitions against Musk to the New York Supreme Court on Friday (February 21), with the first being for sole legal custody of what she claims is their five-month-old son – referred to as ‘RSC’ – while the second is for the Twitter CEO to take a paternity test.
On February 14, St Clair, 26, took to the social media platform to share her claims, writing: “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.”

Musk has yet to address the claims officially, however, he has seemingly responded to the allegations on Twitter.
St Clair has previously claimed in an interview that her and Musk’s alleged relationship began after he ‘slid’ into her DM’s, with the court documents further noting that she claimed the pair began a ‘romantic relationship in or about May 2023’, and how they slept together in January of last year, leading to the alleged conception of RSC, who was born in September 2024.
She also claims that Musk had ‘acknowledged parentage of the child in various written correspondences’, with two images and alleged text messages between the two provided as evidence.
Following the birth of their alleged child, St. Clair sent a picture of her cradling her newborn to Musk, who asked whether they were ‘all well’, to which she replied: “He is perfect.”
“I look forward to seeing you and him this weekend.” Musk allegedly responded.

He allegedly wrote: “I get credible death threats everyday. I’m #2 after Trump for assassination. Wake up.
“This is not the time for sentiment at the expense of safety. If I make a mistake on security, R[full name blacked out] will never know his father.”
While in another conversation, St. Clair sent a picture of herself and a friend to Musk, who replied ‘Hi cutie’, to which St. Clair responded with ‘Hi’ with a loved up emoji, and then ‘see you soon’.
“I want to knock you up again.” the Tesla CEO seemingly replied.
Three months after that exchange, St Clair alleges that Musk then sent another message which said: “Well, we do have a legion of kids to make.”

According to St Clair’s representative, Brian Glickich, had previously told PEOPLE that the author had ‘made every effort to collaborate with Mr. Musk before taking this step’, while her lawyer, Karen B. Rosenthal, wrote in the attorney’s affirmation: “This firm has been dealing with Respondent’s lawyer and representative, Alyssa Rower from Rower, LLC, in an attempt to resolve this matter privately.
“The law firm has offices in Manhattan and Westchester, New York. However, his representatives have been nonresponsive in the past to resolve the outstanding issues and Respondent has indicated that he no longer wishes to resolve issues of custody and support amicably.”
In her request to the court, St Clair wants them to ‘issue a summons, warrant or order requiring the Respondent to show cause why the Court should not enter a declaration of paternity, an order of support and such other and further relief as may be appropriate under the circumstances’.
Elon Musk is being sued over the birth of what author Ashley St Clair is claiming is his 13th child.
The 26-year-old claimed on social media last week that her five-month-old son is fathered by the world’s richest man, and has now filed a petition for sole legal custody to the New York Supreme Court, yesterday (February 21).
Court documents identify the child as only RSC, with St Clair having previously pleaded with the media to ‘honor our child’s privacy, and refrain from invasive reporting’.
Texts allegedly between the pair have been provided to the court as evidence. In one exchange, which notably took place before President Donald Trump won the presidential election in November, Musk urges St Clair to stay quiet.

He writes: “I get credible death threats everyday.

“Wake up.
“This is not the time for sentiment at the expense of safety.

St Clair responds: “That’s why the father spot on his birth certificate is blank right now, E.
“And why he has my last name.”
One minute later, Musk texts: “Necessary for now.
“Only the paranoid survive.”
St Clair replies: “I understand. Apologies if Eva’s text upset you. There has been incredible discretion used here as will continue to be.”
Before Musk concludes: “The threat level will reach insane levels until the election is decided.
“Loose lips sink ships.”

In the court filing, St Clair, a conservative activist who has written a children’s book titled Elephants Are Not Birds – which takes aim at the transgender community – claims that Musk did not attend his 13th child’s birth.
While also saying the Telsa CEO ‘has met him only three (3) times and has had no involvement in his care and upbringing’.
As well as the custody petition lodged with the court, St Clair has also file a paternity petition where she explains the pair began a ‘romantic relationship in or about May 2023’, and how they slept together in January of last year – when RSC was conceived, with the infant being born in September 2024.
Following RSC’s birth, St Clair states how she sent a picture to Musk of her and her new baby to which she alleged he replied: “I look forward to seeing you and him this weekend.”

I have not previously disclosed this to protect our child’s privacy and safety, but in recent days days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.
“I intend to allow our child to grow in a normal and safe environment. For that reason, I ask that the media honor our child’s privacy, and refrain from invasive reporting.”
And Musk has since responded to some of the drama, replying to a tweet sharing an alleged screenshot of tweets between a user called Greg Price and Ashley St. Clair, Musk writing: “Whoa.”
The screenshots shows a tweet from Price on May 20 which says: “He’s got a kid with a woman already. Seems unlikely to work out.”

And a since-deleted post from St. Clair responds: “Well he actually has 7 kids & goes through women pretty fast.”
At the time of writing, Musk has a confirmed 12 children with three other women – St Clair would be the fourth and their alleged child the 13th of his brood.
A user named Milo shared the screenshot, writing: “Ashley St Clair plotted for HALF A DECADE to ensnare Elon Musk.”
What part Musk’s ‘Whoa’ is responding to? Who knows.
St. Clair’s representative, President and CEO of Digital Strategy Ltd, Brian Glicklich, also took to Twitter yesterday (February 15) to share a statement addressing Ashley and Elon’s alleged relationship, noting the pair ‘have been privately working towards the creation of an agreement about raising the child for some time’ and it was ‘disappointing’ a tabloid reporter allegedly ‘repeatedly ambushed’ St Clair and her family and ‘made it impossible to complete that process confidentially’.

However, St. Clair has since opened up further about her and Musk’s alleged relationship and what it was like when she was pregnant, claiming she was sworn to secrecy over the pregnancy and Musk kitted her out with an expensive apartment where she was ‘completely isolated’.

In an interview with The Post, St. Clair claims Musk ‘slid into’ her DMs with something like ‘a meme’ and one thing led to another, and she allegedly ended up meeting Musk at Twitter’s headquarters around two years ago.
Despite branding Musk ‘funny’ and Down to Earth,’ St. Clair claims she was told to keep her pregnancy a ‘secret’ and even ‘asked to keep it a secret forever’.
St. Clair alleges Musk organized an apartment for her in the Financial District – where Apartments.com reports even studios can cost around $3,000-7,000 per month to rent.
St. Clair says she was left in the apartment feeling ‘completely isolated’ during her pregnancy.

“Every part of my career and everything I used to do I couldn’t do anymore. I was told not to tell anybody,” she claims.
The mom reflects she’s ‘sad’ her ‘hand was forced by the media’ to release a public statement but also notes there’s ‘a sense of relief’.
Despite feeling a ‘primary pain’ having to ‘lie and carry this burden and secret’ and ‘lie to the people you love,’ the mother resolves her five-month-old is ‘the most perfect thing’ and she ‘wouldn’t change anything’.
In a post to Twitter on February 15 she added: “In all sincerity, appreciate the kind words. Wish I did not feel the need to make a statement. Kids should be off limits for journalists. Will be spending time with my family & logging off for a while.”
A family who were involved in a car crash when the brakes on their Tesla allegedly failed have since been ordered to pay the electric car maker more than $23,000 in damages.
Zhang Yazhou, from China, was in the passenger seat of a Tesla Model 3 with her father in the driver’s seat as they approached a red light in February 2021.
As any sensible driver would, Zhang said her father stepped on the brakes – only to allegedly realize nothing was happening.
The daughter remembered her father shouting “The brakes don’t work!,” at which point he attempted to swerve around two other cars. Unfortunately they soon ran out of places to go, and the Tesla hit an SUV and a sedan before coming to a stop as it crashed into a concrete barrier.
According to medical records cited by ABC News, Zhang’s mother and father both ended up in hospital for four days after the crash, her father having suffered a concussion.
Zhang and her baby niece, who was also in the car at the time, were thankfully unharmed, but the family’s ordeal was only just beginning.

Zhang takes action against Tesla
After traffic police investigated the crash, it was determined that Zhang’s father was at fault because he hadn’t maintained a safe following distance. However, the daughter hit back as she insisted the brakes had malfunctioned.
She filed a complaint with a local market regulator in the hope of getting a refund and compensation, and requested Tesla send her the pre-crash data from the car – but the company refused.
Describing herself as ‘burning with anger’, Zhang put a banner on her car which read ‘Tesla brake failure’ and positioned it in front of the Tesla dealership in Zhengzhou, the capital of Henan province. She told her family’s story through a bullhorn, but Tesla still refused to hand over the data.
Zhang made a similar showing at an auto show, where she wore a t-shirt saying ‘brakes fail’ and climbed on top of a model car to gain further attention.
She ended up being detained, but her protest went viral and prompted Tesla to claim that Zhang was speaking out to try and get higher compensation. Outraged, she filed a lawsuit against Tesla for defamation.

Tesla fights back
In response to Zhang’s lawsuit, Tesla filed a suit of its own claiming that Zhang had damaged the brand by deliberately spreading false information. The company, which is worth $1.05 trillion, asked for 5 million yuan ($684,000) in damages.
Facing pressure from regulators, Tesla released the data from Zhang’s car, but allegedly did so publicly, including Zhang’s vehicle identification number.
The data showed her father had been driving nearly 120 km per hour (75 mph) prior to the crash, and that the brakes had functioned to reduce the magnitude of the collision. After the data was published, Zhang said her family started being threatened online.
She then sued Tesla a second time, claiming the company had invaded her privacy, but she ended up losing both cases.
As for Tesla’s own case; a Shanghai court ruled last May that Zhang’s comments could not be considered reasonable criticism. Unable to prove the brakes had failed, Zhang lost the case and was ordered to publicly apologize, as well as pay 170,000 RMB ($23,000) to cover damages and the legal costs Tesla had incurred.


Zhang’s appeal
Zhang has since appealed the ruling, telling the Associated Press: “I refuse to accept it. As a consumer, even if I said something wrong, I have the right to comment and criticize. I spoke about my feelings as a user of the car. It has nothing to do with damaging their reputation.”
Though Zhang is determined not to give in, Tesla has a history of success in similar cases. Court filings in China indicate that out of 81 civil judgements in which car owners sued Tesla, the owners only won in nine cases.
