Author Ashley St Clair sues Elon Musk following claim she’d given birth to his 13th child

Elon Musk is being sued over the birth of what author Ashley St Clair is claiming is his 13th child.

The 26-year-old claimed on social media last week that her five-month-old son is fathered by the world’s richest man, and has now filed a petition for sole legal custody to the New York Supreme Court, yesterday (February 21).

Court documents identify the child as only RSC, with St Clair having previously pleaded with the media to ‘honor our child’s privacy, and refrain from invasive reporting’.

Texts allegedly between the pair have been provided to the court as evidence. In one exchange, which notably took place before President Donald Trump won the presidential election in November, Musk urges St Clair to stay quiet.

He writes: “I get credible death threats everyday.

“I’m #2 after Trump for assassination.

“Wake up.

“This is not the time for sentiment at the expense of safety.

“If I make a mistake on security, R[full name blacked out] will never know his father.”

St Clair responds: “That’s why the father spot on his birth certificate is blank right now, E.

“And why he has my last name.”

One minute later, Musk texts: “Necessary for now.

“Only the paranoid survive.”

St Clair replies: “I understand. Apologies if Eva’s text upset you. There has been incredible discretion used here as will continue to be.”

Before Musk concludes: “The threat level will reach insane levels until the election is decided.

“Loose lips sink ships.”

In the court filing, St Clair, a conservative activist who has written a children’s book titled Elephants Are Not Birds – which takes aim at the transgender community – claims that Musk did not attend his 13th child’s birth.

While also saying the Telsa CEO ‘has met him only three (3) times and has had no involvement in his care and upbringing’.

As well as the custody petition lodged with the court, St Clair has also file a paternity petition where she explains the pair began a ‘romantic relationship in or about May 2023’, and how they slept together in January of last year – when RSC was conceived, with the infant being born in September 2024.

Following RSC’s birth, St Clair states how she sent a picture to Musk of her and her new baby to which she alleged he replied: “I look forward to seeing you and him this weekend.”

She has asked Elon Musk to ‘publicly acknowledge his parental role’ with his alleged 13th child

Elon Musk has taken to Twitter amid author Ashley St. Clair releasing a statement about their ‘new baby’.

Author Ashley St. Clair took to social media on February 15 claiming her five-month-old child’s father is the Tesla CEO.

Shared to Twitter, the statement reads: “Five months ago, I welcomed a new baby into the world. Elon Musk is the father. I have not previously disclosed this to protect our child’s privacy and safety, but in recent days days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.

“I intend to allow our child to grow in a normal and safe environment. For that reason, I ask that the media honor our child’s privacy, and refrain from invasive reporting.”

And Musk has since responded to some of the drama, replying to a tweet sharing an alleged screenshot of tweets between a user called Greg Price and Ashley St. Clair, Musk writing: “Whoa.”

The screenshots shows a tweet from Price on May 20 which says: “He’s got a kid with a woman already. Seems unlikely to work out.”

And a since-deleted post from St. Clair responds: “Well he actually has 7 kids & goes through women pretty fast.”

At the time of writing, Musk has a confirmed 12 children with three other women – St Clair would be the fourth and their alleged child the 13th of his brood.

A user named Milo shared the screenshot, writing: “Ashley St Clair plotted for HALF A DECADE to ensnare Elon Musk.”

What part Musk’s ‘Whoa’ is responding to? Who knows.

St. Clair’s representative, President and CEO of Digital Strategy Ltd, Brian Glicklich, also took to Twitter yesterday (February 15) to share a statement addressing Ashley and Elon’s alleged relationship, noting the pair ‘have been privately working towards the creation of an agreement about raising the child for some time’ and it was ‘disappointing’ a tabloid reporter allegedly ‘repeatedly ambushed’ St Clair and her family and ‘made it impossible to complete that process confidentially’.

The statement concluded: “We are waiting for Elon to publicly acknowledge his parental role with Ashely, to end unwarranted speculation, and Ashley trusts that Elon intends to finish their agreement quickly, in the best interests of the wellbeing and security of the child they share.”

Ashley St. Clair has opened up about her alleged romance with Elon Musk and being ‘told to keep it a secret’ she was pregnant.

Author and Conservative activist Ashley St. Clair took to social media, claiming Musk is the father of her five-month-old child – which would mean the Tesla CEO has fathered a whopping 13 kids with four women.

Shared to Twitter yesterday (February 15), the statement from St. Clair reads: “Five months ago, I welcomed a new baby into the world. Elon Musk is the father. I have not previously disclosed this to protect our child’s privacy and safety, but in recent days days it has become clear that tabloid media intends to do so, regardless of the harm it will cause.

“I intend to allow our child to grow in a normal and safe environment. For that reason, I ask that the media honor our child’s privacy, and refrain from invasive reporting.”

However, St. Clair has since opened up further about her and Musk’s alleged relationship and what it was like when she was pregnant, claiming she was sworn to secrecy over the pregnancy and Musk kitted her out with an expensive apartment where she was ‘completely isolated’.

In an interview with The Post, St. Clair claims Musk ‘slid into’ her DMs with something like ‘a meme’ and one thing led to another, and she allegedly ended up meeting Musk at Twitter’s headquarters around two years ago.

Despite branding Musk ‘funny’ and Down to Earth,’ St. Clair claims she was told to keep her pregnancy a ‘secret’ and even ‘asked to keep it a secret forever’.

St. Clair alleges Musk organized an apartment for her in the Financial District – where Apartments.com reports even studios can cost around $3,000-7,000 per month to rent.

St. Clair says she was left in the apartment feeling ‘completely isolated’ during her pregnancy.

“Every part of my career and everything I used to do I couldn’t do anymore. I was told not to tell anybody,” she claims.

The mom reflects she’s ‘sad’ her ‘hand was forced by the media’ to release a public statement but also notes there’s ‘a sense of relief’.

Despite feeling a ‘primary pain’ having to ‘lie and carry this burden and secret’ and ‘lie to the people you love,’ the mother resolves her five-month-old is ‘the most perfect thing’ and she ‘wouldn’t change anything’.

In a post to Twitter on February 15 she added: “In all sincerity, appreciate the kind words. Wish I did not feel the need to make a statement. Kids should be off limits for journalists. Will be spending time with my family & logging off for a while.”

Elon Musk is head of the Trump administration’s Department of Government Efficiency (DOGE)

Elon Musk has raised eyebrows once more.

On Thursday (February 20), Musk made an appearance at the Conservative Political Action Conference (CPAC) and was met with cheers from activists in Washington.

While this isn’t the typical event you’d expect to see him at, Musk, best known for being the CEO of Tesla and founder of SpaceX, has moved his attention to politics of late after being appointed head of the Department of Government Efficiency (DOGE).

He’s also struck up quite a friendship with President Trump, with the pair even doing a joint interview with Fox News in recent days.

While at the conference, Musk appeared onstage wearing shades and his trademark black Make America Great Again hat, he said Argentina’s President Javier Milei had a gift for him.

The president walked onstage with the red chainsaw – engraved with Milei’s slogan ‘Viva la libertad, carajo’ which is Spanish and roughly translates to ‘Long live liberty, damn it’ – and passed it to Musk.

“This is the chainsaw for bureaucracy,” Musk said of the unusual prop while wielding it in the air.

It’s thought that the chainsaw was a metaphor for all the government spending cuts he’s made in the last month.

As per the DOGE website, the organization says it’s saved $55 billion.

This sum has been saved from ‘a combination of fraud detection/deletion, contract/lease cancellations, contract/lease renegotiations, asset sales, grant cancellations, workforce reductions, programmatic changes, and regulatory savings’.

And these savings could see as much as $5,000 back in taxpayers’ pockets.

Trump declared the amount of money saved as ‘incredible’ and suggested that 20 percent of it would be given back to Americans, while another 20 percent would be used to pay off some of the country’s debts.

As of last week, the US was in $36.22 trillion worth of national debt, says Fiscal Data.

The site says that over the past 100 years, the country’s federal debt has increased from $395 billion in 1924 to $35.46 trillion in 2024.

Elsewhere at yesterday’s conference, Musk criticized the previous Biden administration for its immigration policies, specifically naming an app that was used by nearly one million people to be allowed into the US on two-year permits with eligibility to work.

He accused former president Joe Biden and Democrats of doing that as an ‘investment’ to get more support in swing states.

“A lot of people don’t quite appreciate that this was an actual real scam at scale to tilt the scales of democracy in America,” Musk claimed.

Democratic states were told they had not shown why they were entitled to an immediate restraining order

A federal judge has denied a ‘final’ request to block Elon Musk and the Department of Government Efficiency (DOGE) from accessing government data amid cost-cutting auditing efforts.

Despite not being an official government department, DOGE – spearheaded by Musk, the richest man in the world – has been tasked with drastically reducing the federal workforce and cutting any US tax spending that seems unnecessary.

Over the last few weeks, the advisory body has vowed to minimize the US national debt, which stands at $36tn.

It has also terminated various federal contracts, canceled Diversity, Equity, and Inclusion (DEI) programs, and implemented sweeping cuts at the United States Agency for International Development (USAID).

Various Democratic states have rallied together to hamper these cost-cutting efforts, appealing for a temporary restraining order to be put in place.

The lawsuit, brought to Congress, sought to bar DOGE from accessing information systems or firing employees in various government departments, such as Energy, Transportation and Commerce.

The states also wanted those working in Labor, Office of Personnel Management, Health and Human Services and Education to be marked safe from a potential cull.

Other DOGE acts cited in the suit include ‘accessing sensitive and confidential agency data’ as well as cancelling federal contracts.

However, U.S. District Judge Tanya Chutkan claimed on Tuesday (February 18) that the ‘possibility’ that DOGE could harm the country through accessing data systems or making decisions regarding personnel was ‘not enough’ to halt its activities.

“The court is aware that DOGE’s unpredictable actions have resulted in considerable uncertainty and confusion for Plaintiffs and many of their agencies and residents,” Chutkan wrote, as per NBC News.

“Plaintiffs legitimately call into question what appears to be the unchecked authority of an unelected individual and an entity that was not created by Congress and over which it has no oversight.

“In these circumstances, it must be indisputable that this court acts within the bounds of its authority. Accordingly, it cannot issue a TRO, especially one as wide-ranging as Plaintiffs request, without clear evidence of imminent, irreparable harm to these Plaintiffs.”

Chutkan noted that the Plaintiffs – led by New Mexico – had not met the ‘high standard for irreparable injury’ and that the states had not shown why they were entitled to an immediate restraining order, as per Reuters.

“The court is aware that DOGE’s unpredictable actions have resulted in considerable uncertainty and confusion for Plaintiffs and many of their agencies and residents,” she continued.

“When litigants have identified specific individuals or programs imminently targeted by Defendants, courts have issued appropriately tailored [temporary restraining orders].”

Following the ruling, New Mexico Attorney General Raúl Torrez said that he will pursue litigation against Musk and DOGE for ‘as long as it takes to bring this chaos to an end’.

The New York Post reports that Torrez claimed that although he was ‘disappointed’ that the court had failed to issue a temporary restraining order, he will continue rallying for Musk’s ‘unlawful power grab’ to cease.

“Every day that he is allowed to operate without a congressional mandate and with little apparent supervision, Musk is destabilizing our government and disrupting critical funding for education, public health and national security,” the specialist continued.

“His move fast and break things mentality is not only reckless, but also unconstitutional, and we are prepared to pursue this case for as long as it takes to bring this chaos to an end.”

Following the ‘final attempt to stop’ Musk, Chutkan has asked that the Democratic states proposing the block file a proposed briefing schedule by 5pm today (February 19) if they intend to move for a preliminary injunction.
